As a part of his Oct. 7 order, Dearie directed the Justice Department and former President Donald Trump “to confer and attempt to resolve or narrow the disputes regarding claims of executive privilege and designations pursuant to the Presidential Records Act” for Filter A materials from Trump’s Mar-a-Lago residence. The Justice Department filed its position on the matter on Oct. 20, higlighting 12 documents for Dearie to adjudicate on, based on a meeting of the parties on Oct. 19. According to the Justice Department, of those 12 documents, nine had disputes about Presidential record versus personal record categorization, and four had disputes about executive privilege.
This afternoon, Trump’s filing asserted discrepancies for Documents 8, 9, 12, 13, 15, and 16, stating that the Justice Department had mischaracterized its position and “was surprised that the Defendant did not attempt to confirm the contents of its log … to ensure the parties’ respective positions were accurately represented.”
