D.C. Circuit Stays Ruling on Obstruction Charge in Jan. 6 Cases

The U.S. Court of Appeals for the District of Columbia Circuit has granted a stay of a previous ruling in U.S. v. Joseph W. Fischer, which allowed the government to charge more than 300 Jan. 6 rioters with corruptly obstructing an official proceeding under 18 U.S.C. § 1512(c)(2). The stay on the panel’s decision will remain in place pending final disposition of a petition for writ of certiorari before the Supreme Court.
