Frank, of the Hamilton Lincoln Law Institute and the Center for Class Action Fairness, filed his opening brief on Wednesday before the U.S. Court of Appeals for the Eleventh Circuit, which reversed another settlement three months ago because the lead plaintiffs lacked standing.
