Facts: Plaintiff seeks benefits for permanent disability by reason of insanity. Plaintiff asserts military service caused insanity. Trial granted governments motion for a directed verdict stating evidence legal insufficient to sustain verdict for petitioner.

Issue: Did direct verdict deprive Galloway constitutional right to jury?

    Rule: R. 50 a, 7th Amendment.

Application: Judge tested the credibility of O’Neill and Chaplin

Conclusion: The judge was correct in withholding case from jury with insufficient evidence. The directed verdict does not violate the 7th Amendment.
