10th Circ. Upholds Dismissal of Consumer Class Action Against Champion Petfoods

The trial judge had acknowledged that a jury is usually the one to determine whether a statement is false or misleading, but said the plaintiffs’ statements were “‘so general or devoid of specific factual content,’ they are incapable of empirical verification and cannot, ‘as a matter of law, give rise to liability.’”
