“Plaintiff is correct that a genuine factual dispute exists as to whether Jewel or Frito-Lay or both are responsible for removing empty pallet guards. Both parties agree that there is no written agreement that assigns such a responsibility,” said U.S. District Judge Robert W. Gettleman.
