Like Beck, Ellis rejected Podroykin’s claims that he had standing because he alleges that: he suffered emotional distress and fear of potential identity theft and financial fraud from the breach; he overpaid or had the benefit-of-the-bargain injury believing the defendant would protect his information; and he claimed that is personal information values, like credit scores, lowered due to the ransomware attack.
